The legality and decriminalization of psilocybin mushrooms has been evolving across various regions of the world. This list aims to keep track of the legal status of magic mushrooms.

Colorado

In May 2019, Denver became the first city in the United States to decriminalize psilocybin mushrooms. The initiative made the enforcement of laws related to psilocybin possession the lowest priority for law enforcement.

In November 2022, Colorado became the second state to legalize psilocybin mushrooms.

Oregon

In November 2020, Oregon voters passed Measure 109, legalizing psilocybin for supervised therapeutic use in licensed facilities. This measure allowed regulated access to psilocybin-assisted therapy for mental health conditions.

California

Oakland decriminalized all entheogenic plants, including psilocybin, in June 2019, and Santa Cruz followed suit in January 2020, decriminalizing the adult possession and cultivation of psilocybin.

Michigan

In September 2020, the City Council of Ann Arbor passed a resolution declaring the investigation or arrest for the use, possession, or cultivation of entheogenic plants, including psilocybin, as the city's lowest law enforcement priority.

On March 22, 2022, the city of Hazel Park decriminalized natural psychedelics.

Washington, D.C.

In November 2020, Initiative 81 passed, effectively decriminalizing various psychedelics, by creating a framework for a therapeutic model for entheogens including psilocybin, making arrests for their possession the lowest priority for law enforcement.

Washington

Seattle made a significant move concerning psychedelics, particularly psilocybin mushrooms. The City Council passed a resolution deprioritizing the enforcement of laws against the possession and use of entheogenic plants and fungi, including psilocybin.

Massachusetts

In February 2021, the City Council of Cambridge unanimously passed a resolution to deprioritize the enforcement of laws against the use and possession of entheogenic plants and fungi. This resolution aimed to make arrests and investigations related to psychedelics, including psilocybin, the lowest law enforcement priority. The move was part of a broader trend in the United States toward shifting the focus from criminalization to a more health-centered approach concerning certain substances.

Following Cambridge's lead, Northampton, Massachusetts, also passed a resolution in March 2021 to deprioritize the enforcement of laws against entheogenic plants and fungi. The City Council's unanimous decision mirrored the sentiments expressed in Cambridge, aiming to redirect law enforcement resources away from pursuing cases related to psychedelics, such as psilocybin, for personal use.

Maine

October 3, 2023, the city of Portland approved measures to decriminalize psychedelic plants and mushrooms.
